The 2018 Farm Bill helped open up a new world for products that are completely hemp-derived. Compliancy is one of the biggest points in this industry, as everything must come back to being 100% hemp. While products such as Delta 8 THC may seem too good to be true, they are not. It all comes back to them being 100% hemp-derived. 

Compliance-Based

There is a lot of legal jargon that goes along with the hemp industry. However, the most important factor is understanding what hemp is, and why it is legal. 

According to the Farm Bill definition, hemp includes the plant Cannabis sativa L. and any part of that plant. This would include the plant seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers that are growing with or without a delta 9 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis. 

Delta 8 products that are marijuana-derived are illegal according to the US. Controlled Substances Act (CSA) as a Schedule I prohibited substance. Since the products on our site are hemp derivatives, they are not federally controlled substances. Delta 8 naturally occurs in the hemp plant and is specifically derived from hemp CBD. This is done purposefully or as a by-product of the CBD extraction process.

For commercial use, Delta 8 will typically undergo an isomerization process. However, the isomers of hemp and all hemp cannabinoids are allowed under the Farm Bill definition of hemp. This definintion goes on to mention that all cannabinoids, extracts, derivatives, isomers, ect.  identify as part of the hemp plant without distinguishing between any of them. Because of this, Delta 8 THC is a derivative of hemp CBD, is produced from hemp CBD, and is also hemp. This is what makes hemp-derived Delta 8 THC federally legal.

Manufacturing Process

We only work with USDA State Licensed Farms. This means that all of our hemp products fall within compliance for the industry.  Understanding the manufacturing process will help you see that Delta 8 products are in fact legal and fall within the compliancy of this industry. 

The manufacturing process is simple:

  1. Starts as biomass

  2. Converted to crude

  3. Distillate

  4. Isolate

  5. And then D8 distillate. This is used to infuse regular CBD flowers with D8.
